EUROMATCH PRIVACY POLICY

This Privacy Policy explains how EuroMatch collects, uses, stores, discloses and protects personal information. It applies to everyone who uses the Platform, applies to join the EuroMatch database, subscribes, books a Tour, attends an Event, or otherwise deals with EuroMatch.
EuroMatch is an Australian company. It complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This Privacy Policy is available in English and Ukrainian. If there is any inconsistency, the English version prevails. Words defined in the EuroMatch Terms of Use and Code of Conduct (such as Member, Client, Platform, Event and Tour) have the same meaning here.

5. LEGAL BASES FOR PROCESSING (GDPR)
5.1 Where the GDPR applies, we rely on the following legal bases:
(a) performance of a contract (Article 6(1)(b)): processing necessary to assess your application, maintain your profile, provide the Platform, organise Events and Tours, process payments and record Mutual Interest Matches;
(b) consent (Article 6(1)(a) and, for special category data, Article 9(2)(a)): marketing communications, use of your image or story in marketing, the recording of your verification interview, and the collection of health, dietary and accessibility information;
(c) legitimate interests (Article 6(1)(f)): monitoring communications and conduct to protect the safety of Users and EuroMatch Staff, preventing fraud and misuse, securing the Platform, improving our services, and establishing, exercising or defending legal claims. We have assessed that these interests are not overridden by your interests or fundamental rights, having regard in particular to the vulnerability of some Members and the importance of a safe environment; and
(d) legal obligation (Article 6(1)(c)): keeping records required by Australian law and responding to lawful requests from authorities.
5.2 Where we rely on consent, you may withdraw it at any time by contacting the Privacy Officer or using the controls in your account. Withdrawal does not affect processing carried out before withdrawal. If you withdraw consent to processing that is necessary to provide a service, we may be unable to continue providing that service.
5.3 We do not use automated decision making that produces legal or similarly significant effects for you without human review. Automated tools are used to flag messages for review by EuroMatch Staff and to assist identity verification, but any decision to refuse, suspend or remove a User is made by a person.
6. WHO WE DISCLOSE PERSONAL INFORMATION TO
6.1 We may disclose personal information to:

(e) independent registered migration agents, only where you ask us to refer you and only to the extent of your name and contact details;
(f) police, courts, regulators and other authorities in Australia, Poland, Germany or elsewhere, where required or authorised by law or where we reasonably believe disclosure is necessary to prevent a serious threat to the life, health or safety of any person; and
(g) a purchaser or prospective purchaser of the EuroMatch business, subject to confidentiality obligations and to this Privacy Policy continuing to apply.
6.2 We will not disclose a Member's surname, home address, workplace, telephone number, email address or identity documents to any Client, and will not disclose a Client's surname, address or identity documents to any Member, except with the express written consent of the person concerned.
7. OVERSEAS TRANSFERS
7.1 EuroMatch is based in Western Australia. Personal information collected from Members in Poland, Germany and elsewhere in Europe is transferred to and stored in Australia, and may be stored by our hosting providers in data centres in Australia, the European Union or [other regions to be confirmed with the platform developer].
7.2 Australia is not the subject of an adequacy decision by the European Commission. Where we transfer personal data from the European Union to Australia, we rely on the standard contractual clauses approved by the European Commission with our service providers and, in relation to the transfer of your own data to EuroMatch in Australia, on the fact that the transfer is necessary for the performance of your contract with us (Article 49(1)(b) of the GDPR) and on your explicit consent given when you apply (Article 49(1)(a)). A copy of the standard contractual clauses we use is available on request from the Privacy Officer.
7.3 Information about Clients may be disclosed to hotels, venues and service providers in Poland and Germany as described above. Before disclosing personal information overseas we take reasonable steps to ensure that the recipient will handle it in accordance with the Australian Privacy Principles.

8.2 When personal information is no longer required we destroy it or permanently de-identify it.
9. YOUR RIGHTS
9.1 You may ask us for access to the personal information we hold about you and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. We will respond within 30 days. We may refuse access in limited circumstances permitted by law, for example where access would reveal personal information about another User or would prejudice an investigation, and if so we will tell you why.
9.2 If you are in the European Union you also have the right, in the circumstances set out in the GDPR, to:
(a) have your personal data erased;
(b) restrict or object to processing, including processing based on legitimate interests;
(c) receive the personal data you have provided to us in a structured, commonly used and machine readable format and have it transmitted to another controller;

9.3 You may exercise these rights by contacting the Privacy Officer or, where available, through the controls in your Platform account. We will not charge you for exercising your rights unless a request is manifestly unfounded or excessive. We may need to verify your identity before acting on a request.
9.4 Members may at any time ask for their profile to be hidden, withdrawn from the database or deleted, and may withdraw from any Event without giving a reason. These requests are acted on within 2 Business Days and no explanation is required.
10. MARKETING COMMUNICATIONS
10.1 We will send you marketing emails, text messages or app notifications about EuroMatch services only with your consent, which you may give when you register or at any later time. Every marketing message will include a simple way to unsubscribe, and we will act on an unsubscribe request within 5 Business Days, in accordance with the Spam Act 2003 (Cth).
10.2 Service communications, such as Event invitations to Members, booking confirmations and changes to our terms, are not marketing and will continue to be sent while you have an account with us.

11.2 When you first visit the Platform from the European Union you will be asked to choose which non-essential cookies you accept. You may change your choice at any time through the cookie settings on the Platform or your browser settings. Refusing non-essential cookies will not prevent you from using the Platform.

We do not use advertising tools to target Members, and we do not share Members' personal information with advertising platforms.

These steps include encryption of data in transit and at rest, access controls so that EuroMatch Staff see only the information they need, multi factor authentication for administrator accounts, written confidentiality obligations for all EuroMatch Staff and service providers, and secure deletion of identity documents after verification.
12.2 No system is completely secure. If a data breach occurs that is likely to result in serious harm to you, we will notify you and the Australian privacy regulator as required by the Notifiable Data Breaches scheme, and where the GDPR applies, we will notify the relevant supervisory authority within 72 hours and notify you where the breach is likely to result in a high risk to your rights and freedoms.
13. CHILDREN
13.1 The Platform is not directed to anyone under 18 years of age and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a person under 18 we will delete it and close any associated account.
14. COMPLAINTS
14.1 If you believe we have handled your personal information in breach of the Privacy Act 1988 (Cth), the GDPR or this Privacy Policy, please contact the Privacy Officer. We will acknowledge your complaint within 2 Business Days and will investigate and respond in writing within 30 days.
14.2 If you are in the European Union and are not satisfied with our response, you have the right under the GDPR to lodge a complaint with the supervisory authority described above.
15. CHANGES TO THIS PRIVACY POLICY
15.1 We may update this Privacy Policy from time to time. The current version will always be available on the Platform. If we make a change that materially affects how we handle your personal information we will notify you by email or through the Platform at least 30 days before the change takes effect.
