2. PART A: TERMS OF USE
2.1 What EuroMatch is. EuroMatch is an Australian introduction and events company. It maintains a database of women living in Europe who wish to meet Australian men for a genuine relationship, lets verified men view profiles and send messages through the Platform, and holds hosted Events in Poland and Germany at which they can meet in person. EuroMatch does not guarantee that anyone will meet, form a relationship with or marry anyone, or that any person will attend any Event or reply to any message.
2.2 What EuroMatch is not. EuroMatch is not a marriage broker, travel agent, airline, hotel, insurer, migration agent, lawyer or counsellor, and nothing on the Platform is advice of any of those kinds.
2.3 Images and testimonials. Where an image on a public page of the Platform does not depict an actual Member, Client or couple who met through EuroMatch, including images generated by artificial intelligence, the Platform will say so. Where a testimonial is given by a couple who did not meet through EuroMatch, that will be stated. Member profile photographs are photographs of the Member concerned.
2.4 Eligibility. You may use the Platform only if you are 18 or older. You must not use it if you are married or living with a partner (unless separated and disclosed to EuroMatch), or if you have previously been removed by EuroMatch, unless EuroMatch agrees in writing. EuroMatch may require proof of age and identity at any time. EuroMatch decides, at its discretion and without giving reasons, whether to accept any person as a Member or Client.
2.5 Accounts. You must give accurate information and keep it current, keep your login details confidential, hold only one account and not share it. EuroMatch may use automated identity verification; by creating an account you consent to the collection and verification of identity documents under the Privacy Policy.
2.6 Acceptable use. You must not:

2.7 Communication. All communication between Members and Clients takes place through the Platform, and in person only at Events and Approved Meetings. EuroMatch never gives a Member's Contact Details to a Client or a Client's Contact Details to a Member.
2.8 Members and Clients must not give, request or exchange Contact Details in any way, and must not arrange to meet anywhere other than at an Event or an Approved Meeting. The Platform blocks messages containing Contact Details and flags attempts for review by EuroMatch Staff, who may read flagged messages.
2.9 Anyone who communicates or meets outside the Platform, an Event or an Approved Meeting does so entirely at his or her own risk. EuroMatch has no knowledge of, no control over and no responsibility for anything said or done there.
2.10 User Content. You own your User Content and grant EuroMatch a licence to store, display, translate and adapt it on the Platform to provide the services. You warrant that it is yours, accurate and lawful. EuroMatch may edit, decline to display or remove any User Content at its discretion. 2.11 Intellectual property. The Platform and all content other than User Content are owned by or licensed to EuroMatch. You may not use the EuroMatch name or logo without written consent.
2.12 Forum. Statements in any forum on the Platform are the views of the Users who post them. EuroMatch may moderate or remove posts. You must not post anything that identifies any Member or Client or any Event.
2.13 Payments. Prices for subscriptions, Tours and optional services are on the pricing page of the Platform, in Australian dollars including GST. Payments are processed by a third party provider; EuroMatch does not store full card numbers. Women pay nothing to EuroMatch at any time.

2.15 Migration and visas. EuroMatch is not a registered migration agent and does not give immigration assistance or advice, prepare or lodge visa applications, or make any representation about whether any person will obtain a visa. Anyone requiring migration advice must obtain it from a registered migration agent (listed by the Office of the Migration Agents Registration Authority at www.mara.gov.au) or an Australian legal practitioner at their own cost. EuroMatch receives no fee or benefit for any referral. Nothing on the Platform is legal, financial, tax, medical or psychological advice.
2.16 Availability. EuroMatch will use reasonable efforts to keep the Platform available but does not guarantee uninterrupted access and may change or withdraw features.
2.17 Suspension and termination. EuroMatch may suspend or terminate any account at any time at its discretion, immediately where it considers it necessary, including for breach of these terms or the Code of Conduct, false information, or risk to the safety of any person. Refund consequences for Clients are in the Men's Terms. You may close your account at any time. Provisions that by their nature survive termination continue.
2.18 Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

2.21 No director, officer, employee, contractor or Interpreter of EuroMatch has any personal liability to any person in connection with these terms or the EuroMatch services. Any claim may be brought only against EuroMatch Pty Ltd. This clause is for the benefit of each of those persons and may be enforced by them.

3.4 Gifts. A Client may, through EuroMatch and at EuroMatch's published prices, arrange flowers or a similar modest gift to be given to a Member at an Event. The Member may accept or decline. No other gift may be given.
3.5 Events. Every Event is hosted by EuroMatch Staff, including at least one director or tour director, a Ukrainian speaking host, Interpreters and a security attendant. Events are held in public or semi public venues such as hotel function rooms, never in private rooms. Alcohol is served by the venue under local law; EuroMatch Staff may ask the venue to stop serving any person and may require any intoxicated person to leave. Members may leave at any time; EuroMatch Staff will help any Member call a taxi at her own cost. Emergency numbers are 112 in Poland and Germany and 000 in Australia.
3.6 Approved Meetings. After a Mutual Interest Match during an Event Week, EuroMatch Staff may arrange an Approved Meeting if both people wish it, in a public place, during daytime or early evening, with an Interpreter at the request of either. EuroMatch Staff know where and when each Approved Meeting takes place. Either person may decline or end it at any time. EuroMatch does not arrange, and no one may request, overnight stays, travel to other cities or visits to a Member's home.
3.7 Online safety. Any Member or Client may block or report any other person on the Platform at any time. EuroMatch Staff will never ask for a password or for money to be sent to any account; any such request is fraudulent and should be reported.
3.8 No exploitation. EuroMatch never charges any fee to a Member, never pays any Member or any person for recruiting Members, and never pays any person for attending an Event or forming a relationship. No EuroMatch Staff member or Interpreter is paid by reference to the number of matches, meetings or relationships. EuroMatch will not deal with anyone who seeks to introduce women for payment or to speak for a Member. EuroMatch will report to the police any conduct it reasonably suspects to be trafficking, forced marriage, coercion or exploitation, and will cooperate with any investigation.
3.9 EuroMatch Staff must in addition:
(a) keep confidential all information about Members, Clients and Events;
(b) not form or attempt to form any romantic, sexual or financial relationship with any Member or Client;
(c) not accept any gift or payment from a Member or Client beyond a token of nominal value given openly;
(d) interpret accurately and completely, and tell EuroMatch at once if anything raises a safety concern;
(e) not consume alcohol on duty; and
(f) report at once any breach of this Code that they observe.
3.10 Reporting and consequences. Anyone may report a breach to EuroMatch Staff at an Event, through the Platform, or by email to info@euromatch.com.au. EuroMatch treats every report confidentially and does not permit retaliation against a person who reports in good faith. EuroMatch decides, at its discretion, what action to take, which may include a warning, removal from an Event or Tour, removal from the Platform, and referral to the police. EuroMatch may invite the person concerned to respond but is not required to do so, and its decision is final.
4. COMPLAINTS, MEDIATION AND GOVERNING LAW
4.1 Any complaint should be sent to info@euromatch.com.au. EuroMatch will acknowledge it within 2 Business Days and respond in writing within 10 Business Days, or tell you within that time when a full response will be given.
4.2 If a dispute is not resolved through that process, the parties must attempt in good faith to resolve it by mediation before either commences any court proceedings (other than proceedings for urgent injunctive relief). The mediator is to be agreed between the parties or, failing agreement within 14 days, appointed by the President of the Law Society of Western Australia or his or her nominee. The costs of the mediator are shared equally.
4.3 These terms are governed by the laws of Western Australia and the Commonwealth of Australia, and each party submits to the non-exclusive jurisdiction of the courts of Western Australia.
5. GENERAL
5.1 If any provision of these terms is unenforceable it is to be read down or severed without affecting the remaining provisions. A failure or delay by EuroMatch in exercising a right is not a waiver of it.
5.2 EuroMatch may assign its rights and obligations under these terms to a related company or a purchaser of its business on written notice. No other party may assign without EuroMatch's written consent.
5.3 EuroMatch is not liable for any failure or delay caused by an event beyond its reasonable control, including war, civil unrest, terrorism, epidemic, government direction, border closure, hotel or venue failure, natural disaster or failure of telecommunications, provided that where a paid service cannot be delivered EuroMatch refunds in accordance with these terms.
5.4 These terms, with the documents incorporated into them, are the entire agreement between the parties about their subject matter. Nothing in this clause limits liability for a misleading representation under the Australian Consumer Law.
5.5 EuroMatch may vary these terms on at least 30 days' written notice. A variation does not apply to a Tour already booked or a subscription period already paid for unless required by law or more favourable to the other party. A person who does not accept a variation may end the agreement before it takes effect and will be refunded for any paid service not yet provided.
5.6 Notices to EuroMatch must be sent to info@euromatch.com.au. Notices to a Member, Client or User may be sent to the email address or Platform account last notified and are taken to be received on the next Business Day.
